2. 投(得)標廠商違反前款規定時，本公司得向投(得)標廠商請求本專案金額百分之五之損害賠償；前述賠償金額及溢價及不當利益，本公司得自應給付之契約價款中扣除；本公司並得終止或解除契約。 |
